Testamentary Trusts
A Testamentary Trust is a Trust which is incorporated into a Will to address the specific circumstances of any beneficiaries. For example, a young child's inheritance can be included in a trust to ensure it's available to them at a later date.

A Testamentary Trust may be also useful for beneficiaries who:

Suffer from a disability

Lack financial skill and are likely to waste their inheritance if it is paid to them directly

Run a business or work in an occupation that exposes them to risks that may threaten their inheritance

Or may be going through a breakdown of a defacto relationship or marriage and are at risk of having their inheritance included in the matrimonial asset pool which is to be divided between the parties in the Family Court.
Power of Attorney
Appointing an attorney gives them the legal authority to look after your financial affairs on your behalf, either for a particular period of time, or upon a medical practitioner confirming that you have lost the capacity to make decisions for yourself.

You can appoint an attorney to act for you in a variety of circumstances such as an extended interstate or overseas trip, or for a time when you are no longer able to manage your own affairs.

Family Provision Claims
A Family Provision Claim is an application to the Supreme Court of New South Wales for a share or a larger share from the estate of a deceased person.
You can make a Family Provision Claim if you:
